DMCA Reports
TeeMinder respects the work of artists and rights holders. This page explains how to report a copyright concern under the Digital Millennium Copyright Act and what happens after you do.
1. Our commitment
TeeMinder sells printed products from a catalog our team puts together; customers don’t upload designs to this site. If you believe one of our listings uses your copyrighted work without permission, we want to hear about it, and we act on complete notices promptly.
2. How to send a notice
Section 512(c)(3) of the Copyright Act (17 U.S.C. § 512(c)(3)) lists what a notice must contain. Put yours in writing and include each of these six items:
- A physical or electronic signature belonging to the copyright owner, or to a person they have authorized to act for them.
- Which copyrighted work is affected. For several works, a representative list is acceptable.
- The listing on our site that you believe infringes, described clearly enough for us to find it. The full product page address is ideal.
- Ways for us to contact you: an email address, a phone number, and your full name with a postal address.
- Your good faith belief, stated plainly, that the use you’re objecting to hasn’t been permitted by the copyright holder, anyone acting for the holder, or the law.
- Confirmation that the notice is accurate. You also need to declare that you are the copyright holder, or authorized by the holder to act, and make that declaration under penalty of perjury.
3. Where to send it
Email your notice to our Copyright Agent:
TeeMinder — Attn: Copyright Agent
Email: support@teeminder.com
A subject line that begins with “DMCA Notice” followed by the product name helps your message reach the right person quickly.
4. What happens next
When we receive a complete notice, we:
- Remove or disable access to the listing you identified.
- Keep a record of the notice and of what we did.
- Write back to confirm that the listing has been taken down.
TeeMinder is a single store, not a marketplace, so the listing is ours and we handle the removal ourselves. Where the artwork was supplied to us by someone else, we let that party know about the notice so they can respond. If a notice is missing any of the required elements, we’ll reply and ask for what’s missing.
5. Counter-notice
Think a listing was taken down by mistake, or because the material was misidentified? You can respond with a counter-notice under 17 U.S.C. § 512(g)(3). Please include:
- Your signature, physical or electronic.
- Which material we removed or disabled, and the place on our site it occupied beforehand.
- Your good faith belief that the material came down through a mistake or a misidentification, stated under penalty of perjury.
- Your full name, address and telephone number.
- Your consent to the authority (jurisdiction) of the federal district court serving the U.S. judicial district that contains your address or, if your address is abroad, of any judicial district where TeeMinder can be found.
- Your agreement that the original complainant, or their agent, may serve you with legal process.
We pass a valid counter-notice along to whoever filed the original notice. We may then put the material back 10 to 14 business days after your counter-notice reaches us, unless the original complainant first informs us that they have gone to court seeking an order to stop the alleged infringement.
6. Repeat infringement
We keep a record of every valid notice. A design that draws a valid notice stays out of our catalog, and we stop working with any source that repeatedly supplies infringing artwork. We may also close the account of a customer who repeatedly submits infringing personalization content.
7. Misrepresentation
The DMCA, at 17 U.S.C. § 512(f), holds people responsible for knowingly and materially false claims, whether they falsely say a listing infringes or falsely say material was pulled in error. Liability can include damages, costs and attorneys’ fees. Please make sure your notice or counter-notice is accurate, and consider talking to a lawyer if you’re unsure.
8. Non-copyright issues
This process covers copyright. If your concern is about a trademark, a right of publicity or another kind of right, email support@teeminder.com anyway with the details, the listing’s web address and proof of your rights, and we’ll review it and reply.
